Law No. 08/L-267 on Identification Cards: Significance and Impact in Kosovo

On August 9, 2024, the Republic of Kosovo passed Law No. 08/L-267 on Identification Cards, which brings significant reform to the administration and use of ID cards in the country. This law represents a major step forward in the standardization of identification documents and provides an improved system for protecting citizens’ personal data.

Purpose of the Law

The Law on Identification Cards aims to establish the conditions and procedures for issuing ID cards, making this process clearer and more standardized. It also includes aspects of personal data protection and compliance with international standards, based on Regulation (EU) 2016/679 on personal data protection and Regulation (EU) 2019/1157 on strengthening the security of ID cards.

Scope and Use

The law applies to the responsible authorities that issue ID cards and to individuals and entities that use these documents. It mandates that all citizens of Kosovo must possess an ID card, with certain exceptions for those living abroad or individuals under the age of sixteen (16).

Obligations and Rules for Using ID Cards

The law introduces several obligations for citizens, including carrying their ID cards in either physical or electronic form and prohibiting the use of others’ ID cards. It also forbids altering, writing on, or erasing information on the ID card. The document can also be used for accessing electronic services and crossing borders, where permitted.

Competent authorities and issuance procedures

The relevant Ministry of Internal Affairs is the competent authority for issuing and personalizing ID cards, including the placement of electronic certificates on the chip. The law also sets deadlines for issuing ID cards, with procedures ranging from fifteen (15) days within Kosovo to thirty (30) days at diplomatic and consular missions.

Security and Data Protection

A key aspect of the law is the use of electronic data in ID cards. Biometric data, such as fingerprints and photographs, are stored on the chip and used for identification and electronic verification. The law clearly states that this data can only be used for identity verification and is protected in accordance with the law on personal data protection.

Procedures for Replacement and Damage of ID Cards

The law outlines clear procedures for replacing ID cards in cases of changes in personal data, damage, or loss. Citizens are required to report damage, loss, or theft of their ID cards and apply for new documents according to the prescribed procedures.
